The Supreme Court agreed Thursday to hear a challenge to the administration's policy of detaining undocumented immigrants without bond hearings during deportation proceedings.
- Justices accepted the case of Ricardo Aparecido Barbosa da Cunha, a Brazilian national arrested in Massachusetts in September 2025 after more than 20 years in the US.
- The July 2025 policy reversed a decades-old rule; most federal appeals courts rejected it, while the 5th and 8th circuits upheld it.
- Administration attorneys said the lower-court split disrupts the orderly administration of immigration law and creates an "unworkable patchwork" of enforcement.
- The ACLU, representing the plaintiffs, said the government's interpretation could affect millions of noncitizens.
